Harten Frameworks Ltd T&Cs
1. Price and Payment
(a) For the goods and services to be supplied by Harten Frameworks Ltd, the price will be stated excluding VAT.
(b) Once a quote is approved Harten Frameworks Ltd will submit an invoice for 50% deposit payment of the total price, with this payment due before we start work or order in materials. The remainder 50% payment is due on completion of the work and before delivery or collection. We are happy to send images of proof of completion if required.
(c) For very bespoke projects, estimates will be given and the final invoice may vary by approx 10%.
2. Orders/Specifications
(a) Verbal orders for goods and/or services to be supplied by Harten Frameworks Ltd will be confirmed in writing through emails, quotes or on invoice before work commences.
(b) Any frame supplied without artwork will rely on measurements supplied and confirmed by you - Harten Frameworks Ltd will not be responsible for incorrect measurements.
(c) Orders will be considered as confirmed & understood on receipt of invoice and payment of the deposit. Please ask for clarification of the work if you are unsure.
3. Guarantee
The workmanship & quality materials in our hand-finished frames are guaranteed for 5 years. We are not liable for defects in 3rd party products or pre-finished profiles not made by Harten Frameworks Ltd.
4. Rescheduling or Cancellation
If you wish to cancel all or part of the written order, or request changes to the agreed completion/delivery date or agreed specification please provide written notification. We will do our best to accommodate any changes but reserve the right to make a cancellation charge(s) which will be based on the amount of notice provided and will include without limitation all monies committed or incurred by Harten Frameworks Ltd as a result of your written order.
5. Indemnity
You shall indemnify Harten Frameworks Ltd against all liabilities, claims, demands, damages, losses, costs and expenses which may be incurred or brought against Harten Frameworks Ltd in respect of injury to any person or loss or of damage to any property arising out of or in connection with the use by you of the goods and/or services as a result of any negligent act or omission by you or of any breach by you of any of our obligations.
6. Insurance/consignment notes
Artwork is insured while in the workshop of Harten Frameworks Ltd. To access this on a case by case basis please ask if you wish your work to be covered by our insurance. You will need to provide proof of market value and we will note this in the job sheet along with a condition report on the piece. This will then form the ‘Consignment Note’ for our insurance purposes. We will also then offer insured options for delivery.
7. Delivery/Collection
Delivery costs will be quoted separately based on the estimated size and weight of the finished framed artwork, and may vary. We offer 4 options:
(a) Direct to your door same day courier service, lightly packed by us.
(b) Consolidated weekly courier, medium packaging by us.
(c) UPS/DHL etc, heavily packed by us.
(d) You are welcome to arrange your own courier or collect in person. Insurance options available on request as per no 6.
Please examine goods on delivery and let us know of any issues within 48 hours. If damage is reported later than this we can’t claim on 3rd party insurance for you.
8. Storage of Property
Completed work should be collected within 3 weeks of completion. If work is left for longer than this we reserve the right to charge storage fees. Work will not be kept for longer than 3 months without written agreement by Harten Frameworks Ltd.
9. Ownership
Ownership of the goods supplied by Harten Frameworks Ltd will pass to you when the agreed price and any monies outstanding from you to Harten Frameworks Ltd are paid in full.
10. Force Majeure
Harten Frameworks Ltd will not be held liable for any failure to supply the agreed goods and services by reason of any event beyond their reasonable control.
11. Variation
No variation of these Terms & Conditions of Business and no verbal stipulations or representations will be binding on Harten Frameworks Ltd unless expressly agreed to in writing.
12. Termination
(a) Harten Frameworks Ltd may terminate the contract if:
(i) you fail to make any payment due in full.
(ii) you cause any breach of your obligations.
(iii) you become insolvent, or go into liquidation, or cease trading or similar.
(b) Termination of these Terms & Conditions of Business will be without prejudice to any rights accruing or already accrued to either party at the date of termination.
(c) Upon termination of these Terms & Conditions of Business for any cause, all sums accrued due to Harten FrameworksLtd will immediately become due and payable to Harten Frameworks Ltd.
